This agreement is between the Marion Sun and Vendor for a vendor space for the Made In Iowa.

Vendor agrees to observe and abide by the following terms, conditions, and rules.

Only one Vendor is permitted to sign this lease agreement. Management shall assign to each Vendor a  space for the period of the Event.

Dates, Time and Location

Made In Iowa takes place 10am to 3pm at the Hawkeye Downs Expo Center located at 4400 6th St SW, Cedar Rapids, IA 52404.

Made In Iowa date is February 1, 2025.

The Made In Iowa does not provide any additional set up equipment or supplies. It is the responsibility of the vendor to provide any cash registers or cash boxes, signage, decoration, display equipment, and proper City, County, State and Federal Licenses necessary to do business and labeling of merchandise.

Set Up Policy

Final set up details will be shared prior to the market day. Assigned spaces will also be communicated prior to market day. General set up times are below:

  • Vendors will be directed to move to their designated space beginning at 7:00 am and may begin to set-up.
  • Vendors arriving after 9:45 am will be placed at the discretion of the Management.

Market Rules and Regulations

  1. Vendors must comply with any public health guidelines.
  2. The market operates regardless of weather conditions. Vendors are required to remain for the entire duration of market hours as specified in this document.
  3. Vendors are not permitted to sublet their space or allow others to sell items that are not produced or manufactured by the vendor themselves.
  4. No nails, thumb tacks or tape will be used on the Hall walls or ceiling.
  5. NO GLITTER or CONFETTI will be used in the Hall.
  6. Vendors can only sell from their assigned space and are responsible for maintaining cleanliness in and around their space, including counters and shelves, at all times. Additionally, at the end of the Market, vendors must thoroughly clean their area and remove all personal equipment, produce, products, and debris.
  7. The display or sale of obscene, illegal, or unsafe merchandise is strictly forbidden. The Management has the sole authority to determine what constitutes such merchandise.
  8. Vendors must exhibit food and produce on well-constructed, well-maintained, and clean tabletops or shelves. Market management highly recommends that vendors create appealing displays.
  9. The area is designated as a no-smoking zone. Vendors are prohibited from smoking while conducting business at the market.
  10. Should the Vendor, or any of their employees, agents, or representatives, arrive at the market under the influence of alcohol or drugs, they will lose the right to their stall for either that day or the entire market season.
  11. Playing music at vendor space is not allowed.
  12. Vendors are prohibited from bringing pets to the market.
  13. All individuals occupying the vendor space are required to wear shoes.
  14. Vendor must possess necessary permits or certificates for those items requiring such. Vendor is responsible for compliance with all state, federal, and local laws regarding vending and labeling of merchandise.
  15. The Marion Sun retains the authority to deny vendors access at any time for any reason, and no refunds will be provided.
  16. Management reserves the exclusive right to revise floor plans and/or move assigned Vendors as it deems necessary.
  17. Vendor is liable for any damage caused to Facility floors, walls, or columns, or to standard equipment, or to other Vendor’s property.

Tear Down Policy

Vendors will have 2 hours to tear down and leave their space.  Leave your space as you found it – empty, picked up and swept clean. Any items not removed by the designated move out time (3:45 pm) will become the property of the Market management. A clean-up fee of $50 per occurrence will be charged to the vendor if necessary.

Cancellation Notification

There are no refunds. Vendors must inform the Marion Sun at least one week prior if they are unable to attend a market day. Upon such notification, the Marion Sun may use or lease the stall. No refund will be provided for absence. A no-show fee of $50 will be imposed if the Marion Sun staff is not informed of a vendor’s absence by noon on the Wednesday preceding the market date. The vendor must settle this fee before participating in future markets.

Disclaimer

Management has the sole right to determine the eligibility of any company or product for inclusion
in the Event. Management makes no representation or warranty, express or implied, regarding the number of persons who will attend the Event.

The Marion Sun is not responsible for any damage or loss incurred by the Vendor due to unforeseen natural events. The Vendor agrees to not hold the Marion Sun responsible for any claims or legal actions related
to any damages or liabilities that may arise from their use of the allocated space or from their activities related to the sale or distribution of products at the market.

Limitation of Liability; Indemnity. Neither Marion Sun nor the Facility, nor any of its officers, agents, employees or other representatives, shall be held liable for, and each is hereby released from any damage, loss, harm or injury to the person or property of the Vendor or any of its visitors, officers, agents, employees or other representatives, resulting from Vendor’s participation in the Event. Vendor shall indemnify, defend and hold harmless Marion Sun and the Facility and their respective owners, directors, officers, employees,
agents and representatives, from, any and all claims, demands, suits, liability damages, loss, costs, attorney’ fees and expenses of any kind which might result or arise from its participation in the Event, its
licensing and/or use of exhibition space hereunder or any action or failure to act on the part of Vendor, or its officers, agents, employees or other representatives.

If Hawkeye Downs Expo Center should be destroyed by fire or if a strike makes it impossible for Made In Iowa management to permit an exhibitor to occupy the premises, the exhibitor shall pay for the space
only for the period in which the space was occupied. Marion Sun is released from any and all claims which might arise in consequence thereof. If any other event or circumstance not caused by Made In Iowa management  prevents an exhibitor from erecting or staffing his exhibit or all or any part of the show period, the contractual responsibility between the exhibitor and Marion Sun shall be considered to be satisfied
and there shall be no refund to the exhibitor.
